Conditions of Loan
1. Loaned Works
The Lender lends to the Borrower the work(s) listed in the Schedule below, for the exhibition and period stated.
2. Loan Period
The loan runs from ____________________ to ____________________, inclusive of outward and return transit. Any extension requires the Lender’s prior written consent.
3. Purpose and Venue
The work(s) may be displayed only in the exhibition and at the venue(s) named above. They may not be moved to another venue, lent onward, or displayed for any other purpose without the Lender’s prior written consent.
4. Insurance
The Borrower shall insure each work wall-to-wall (nail-to-nail) for the agreed value stated in the Schedule, against all risks of physical loss or damage, from the moment of packing at the Lender’s premises until return delivery and unpacking. Evidence of cover shall be provided to the Lender before collection.
5. Packing and Transport
Packing, transport and installation shall be carried out by a specialist fine-art shipper approved in advance by the Lender, at the Borrower’s expense. Original packing materials shall be retained for the return journey.
6. Condition Reporting
A condition report shall be made and signed by both parties on despatch and again on return. Any change in condition shall be reported to the Lender immediately, in writing, with photographs, and before any remedial action is taken.
7. Display Conditions
The work(s) shall be displayed at 50% ± 5% relative humidity and 20°C ± 2°C, with illumination not exceeding 200 lux for paintings and 50 lux for works on paper, photographs and other light-sensitive media, and with ultraviolet radiation filtered to below 75 µW/lumen.
8. Handling and Intervention
The work(s) shall be handled only by trained personnel. The Borrower shall not clean, restore, re-frame, re-mount, or alter the work(s) in any way, and shall not remove any label, plate or marking.
9. Photography and Reproduction
Copyright remains with the artist. The Borrower is granted a non-exclusive, non-transferable right to reproduce images of the work(s) solely for the exhibition catalogue, exhibition publicity, press use in connection with the exhibition, and the Borrower’s archival records. No other reproduction, and no commercial merchandising, is permitted.
10. Credit Line
The work(s) shall be labelled and credited in all catalogues, wall texts and publicity exactly as follows: ____________________________________________.
11. Return
The work(s) shall be returned to the Lender at the address stated, at the Borrower’s expense, on or before the end of the loan period. Risk passes back to the Lender only on delivery and acceptance.
12. Liability
The Borrower is liable for loss of or damage to the work(s) while they are in its care, custody or control, whether or not caused by its negligence, save for loss or damage arising from inherent vice or from the Lender’s own act or omission.
The Borrower confirms it has read the Conditions of Loan, is able to meet the display and environmental requirements in clause 7, and accepts the liability in clause 12.
